Photojournalist Larry Birkhead has hired celebrity attorney Debra Opri, who filed court papers on his behalf in L.A. Superior Court on Monday to establish paternity and custody of the child.

Court papers reportedly claim that Anna Nicole was hospitalized to detox from a drug addiction.

That's just one of the jaw-dropping claims being made today. Sources tell ET that Anna Nicole has allegedly been addicted to methadone -- the same drug that was found in her son DANIEL's system when he died -- for nearly three years.

Birkhead also reportedly claims in the court papers that this pregnancy was not the first time Anna Nicole was pregnant with his child. Sources say the former lovers got pregnant, but that she miscarried in February of 2005.

This is getting sicker by the day. I hope that poor little baby isn’t addicted. Maybe that’s why she’s staying in the Bahamas.

This story line is getting deeper and deeper.  I’d hate to think I had a drug and my kid got it and died from it. I’d also hate to think I’d have a kid and two men saying they were the dad.  I’d also hate to have married a really old man.  lol.

All these “new developments” aside, what in the hell was her 20 year old son Daniel doing “sleeping in the same bed as his mother” when she woke up and found him dead?  Okay, I have a grown son also, but..what the hell was up with that???  Who gave him this methadone?  His mother? 

Many more developments to come, I’m sure, although I’m already sick of this whole getting sicker by the moment affair.

Anna sent her son to the grave!!  She raised him around all this wacky behavior of drug abuse, alcoholism,  sleeping with various men, and marrying an old man who had one foot in the grave.  What chance did Daniel have at a normal life?  I blame Anna and Howard for not seeking help for Daniel with his bout of depression.  Instead, they handed him these drugs carelessly with wreckless abandon!  Shame on them!

I agree vtgal, what 20 yr. old sleeps on the same bed with his mother?  I think their household was addicted to prescription drugs for many years.

Just because Larry Birkhead has made these allegations doesn’t mean they are true.

Wow this keeps getting more strange has the days go on. If Daniel did get the methadone from Anna….man i’d hate to live with the guilt shes going to be living with her entire life knowing that she pratically killed her son. And her daughter is only about a month old and already there is such controversy about whos her dad. Next thing we know their going to be on Maury!!!!

What a dick to do this to her right now. I don’t care if he is the father, he isn’t doing anyone any good by doing this. Men are really pigs. You can dress them up, make them look pretty, teach them to dance, but deep down they will always be pigs.

All this is sheer lunacy!!!

He was sleeping in the CHAIR next to her bed, in her hospital room.  Remember that part where she was in the hospital after delivering the baby and he flew in from the states to visit them?  I’ve done that (sleeping in the chair or on a mat next to the hospital bed) when my son was in the hospital, and family members have done it when I was in the hospital.  I haven’t seen one single news report anywhere that has said he was found IN her bed. 

No wonder gossip gets so out of hand, people can’t remember details of a news report from one minute to the next!  Get some Adderall, y’all, and pay attention!

ribblefizz - I don’t have time to confirm this right now as I’m almost leaving work but I SWEAR that Stern said on Larry King that Daniel was sleeping next to her IN her bed, not a chair as first said.  I have a good memory for stupid hollywood details and I wouldn’t have written that if I hadn’t seen or heard it from a source close to Anna. 

But anywhoo…the whole situation is a sick and sad one.

If Anna is doing methadone she shouldn’t have the baby, period. If Birkhead is the father (which I tend to believe he is) he has every right to demand her return to the states. He has every right to demand a paternity test and every right to demand she and the baby are tested for methadone.

I don’t think he’s being unreasonable at all, if she is indeed his child. I wonder if people would be saying it’s unreasonable if the roles were reversed, and it was the father, allegedly addicted to pills, taking a baby to the Bahamas without the mothers consent, and the mother was demanding the return and testing.

I can’t think of any real reason for him to be lying, but her behavior in the last several years sure has been indicative of some sort of drug use. Remember the awards show where she couldn’t even speak?

PUHLEASE, for those of y’all who think Anna isn’t abusing drugs, should wake up and smell REALITY! 

I do remember the MTV awards show where Anna was SO out of it,  she was SLURRING her words while pointing to her Trimspa pendant saying, “like my body.”  If that isn’t someone on drugs, then Anna should seek professional help from a Neurologist.

I also saw Howard’s Larry King Live interview and he seemed like he’d been popping pills too with his eyes all glossy and speaking semi-incoherently.

Anna may have had her problems with drugs as it was pretty evident at that MTV awards show, however, I think we must give Howard K. Stern the benefit of the doubt.  His glossy eyes or dark circles and incoherence could easily be attributed to suffering the effects of grief and mourning the loss of Daniel.  I think that’s a cheap shot on Howard.

this storyline simply gets more depressing by the day.. she’s never been a role model for anything.. she married some old dude, got his money, did her thing and voila.. trauma, drama and tragedy again and again.. i think we’ve heard enough about her.. how bout that aldo and mary worth huh??? http://www.stingybitches.com/comic.html

Wow and to think it all started with a simple story of her losing her son, now her whole damn life is surrounded with mysteries.

I said Howard “seemed like” and be that as it may,  it still doesn’t excuse the fact that both Anna and Howard were negligent guardians of Daniel’s life.  They were his family and they obviously failed at helping him.

SOMEONE gave that kid Methadone at some point in the evening prior or early next morning.  It was in his system.  It certainly wasn’t brought to him by the nurse on call that night for cripes sakes.  The only people in that room were Anna, Stern, and the new baby.  Hmmmm….

Vtgal, I have been thinking the same thing. They need to see who had a valid script for the methadone and who did not. This certainly is not a case of intentional foul play but it may be a case of negligence.
And, it has been SO obvious over the years that Anna is suffering from addiction. Look at her reality show and her public appearances. Remember the atrocity at all the award shows. Come on, of course she is an addict. I feel for her, I truly do, but facts are facts.

^^YEP!  Someone did in fact give Methadone to Daniel.  One or both of these two imbeciles did and I hope not a day goes by that they don’t cry or regret what they did to him.
